Introduction

Our Terms of Use are a contract between you and FinBud Technologies Limited. You must accept these terms to use our Services. Before using MonBud, please carefully review these Terms of Use. Your use of our service is subject to your agreement to comply with these provisions.

By creating an account or using our Services you confirm that you accept these Terms. If you disagree with any part hereof, do not access the App. You also confirm that:

1. You have reached the age of 18. (or such age required in your country or territory for you to be authorized to register for and use our Services without parental approval). In addition to being of the minimum required age to use our Services under applicable law, if you're below the minimum age required by law to use our Services, you must seek parental approval. If you don't have the authority to agree to our Terms due to your age, your parent or guardian must agree to our Terms on your behalf.
2. We may make changes to the terms and conditions of our services, but we will always inform you of any modifications in advance. You will be able to find all updates on our website and app. You can access the latest version of our terms at any time. If you do not agree with any changes, you have the option to stop using our Services and delete your account. By continuing to use our Services after the updated Terms become effective, you confirm that you understand and accept the updated Terms

About Our Services.

The MonBud Application and Services is a product of Finbud Technologies Limited ®

It is a financial service app designed to help individuals grow their personal and family finances, set and meet their financial goals as well as gain financial insights and recommendations.

Subscription

We provide our services for a subscription. You can choose which plan suits you under our monthly, biannual or annual subscription plans. This subscription can be canceled by the user at any time.

Multiple Profiles

A user account can have up to three profiles (sub-accounts) in other words, a paying account can give two other persons access to the application via their account, a shared account model with the paid account retaining profile management.

Paid user-associated profiles or Sub-accounts do not have to make subscription payments because the main account covers them. Subaccounts may have certain features restricted such as account & user management, events & livestream access.

Fees And Taxes

You are responsible for paying all carrier data plans, Internet fees, taxes, and other associated fees for using our Services.

Third-Party Services

Our Service may be integrated with or may allow you to access, use, or interact with third-party websites, applications, content, and services (such as payment gateways, cloud storage etc.). Please note that these Terms and our Privacy Policy apply only to the use of our Services. When you use third-party products or services their terms and privacy policies will govern your use of those products or enabled services.

Privacy and User Data

We at MonBud care about your privacy. Our Privacy Policy outlines our data practices, which include the information we receive and collect from you, how we use and share this information, as well as your rights regarding the processing of your personal information.

Acceptable Use of Our Services

Our Terms & Conditions

You shall use our Services according to our Terms & conditions. If you violate our Terms, we may take action concerning your account, including disabling or suspending your account and, if we do, you may not create another account without our permission. You can find out how to disable or terminate your account in the “Termination“ section below.

Securing Your Account

• You are responsible for all actions conducted using your computer (personal or otherwise), mobile phone, tablet or other electronic device or account. It is your responsibility to keep all of these secure.
• Your passwords must be kept secret. You are liable for all activities undertaken using your username, associated password or device. You are responsible for maintaining the confidentiality of all account information and keeping your device from unauthorized use.
• We accept no liability for any unauthorized use of your device or account or any effects of the same.
• In the event, your device has been stolen or there is unauthorized access to your account, it is your responsibility to immediately notify us to restrict activities on your account.
• In the event, your Device has been stolen or there is unauthorized access to your MonBud account, it is your responsibility to immediately complain to support@finbudtechnologies.com

Legal Use

You must access and use our services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our services in ways that: (a) violate, misappropriate, or infringe the rights of our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) are illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, racially or ethnically offensive, or instigate or encourage conduct that would be illegal or otherwise inappropriate, such as promoting fraud, financial crimes, and money laundering among others; (c) involve publishing falsehoods, misrepresentations, or misleading statements.

Unacceptable Use

• You will not reverse engineer, decompile, disassemble or make any attempts to discover the source code or algorithms of our services.
• You will not modify or disable any features of our services.
• You will not create any derivative works based on our services
• You will not rent, lease, lend, sub-license or provide any commercial hosting services using our services.
• You will not use our services in any way that violates these terms or any laws, rules, regulations, codes of practices, guidelines or any other requirements of regulatory authorities, as amended from time to time, within the jurisdiction in which you are a resident or from which you are using the services (“applicable law”).
• You will not use our services in any fraudulent or malicious way, for example, to introduce viruses, malicious code or harmful data.
• You will not use our services in any way that could damage, disable, overburden, impair, or compromise our systems or security or interfere with other users.
• You will not collect or harvest any information or data from our services or systems or attempt to decipher any transmissions to or from the servers running our services, except to the extent allowed by applicable law.
• You will not engage in harsh, divisive, and mindless communication on the platform.

Intellectual Property

All of the content on MonBud, including text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively referred to as “content“), such as the design, structure, selection, coordination, expression, “look and feel“ and arrangement of such content is either owned, controlled or licensed by FinBud Technologies Ltd. The content is protected under trade dress, copyright, patent and trademark laws, as well as other intellectual property rights and unfair competition laws.

Except as expressly provided in these terms of use, no part of MonBud and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring“) to any other computer, server, web site or other medium for publication or distribution or any commercial enterprise, without MonBud’s express prior written consent.

You may use information on MonBud’s products and services (such as data sheets, knowledge base articles, and similar materials) purposely made available by MonBud for downloading from the Site, provided that you (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents.

All copyright, trademarks and other intellectual property rights used as part of our services or contained on the App belong to us or its licensors. Nothing outlined in this Terms of Use shall constitute a transfer, license or assignment by us to you of any Intellectual Property Rights owned by us or displayed on the App.

Notices

Your email address and phone number supplied at sign-up will be used as a means of communicating information, notices and documents to you such as Goal Timeline Reached, Subscription Expiration etc

When you break the rules of communication on the platform, your account will be deactivated. Once your account is deactivated, you will be restricted in what you can do on the app. If your subscription is active at the time, you will be able to access premium features. However, while you will be allowed to read content posted by other users, you will not be able to write content on the app that other users can read. You will be free to cancel your subscription by yourself, anytime you want.

Limitation Of Liability & Disclaimers

Subject to the provisions of the governing law over this agreement:

Indemnification

• You agree to indemnify FinBud Technologies Limited, its subsidiaries, affiliates, officers, merchants, agents and employees for any loss, damages, liabilities, sanction, claims, suits, fines, charges, or expenses due to or arising from any transactions processed or sent through the MonBud App.
• You agree to indemnify FinBud Technologies Limited and its subsidiaries, affiliates, officers, merchants, agents and employees for any loss, damages, liabilities, sanction, claims, suits, fines, charges, or expenses arising from your violation of this Terms of Use.
• You agree to indemnify FinBud Technologies Limited and its subsidiaries, affiliates, officers, merchants, agents and employees for any loss, damages, liabilities, sanctions, claims, suits, fines, charges and expenses arising out of your implementation of any advice given by a user on the MonBud platform.

Availability and Termination

Availability Of Our Services.

Our services are constantly being improved, and this may include expanding, adding, or removing services, features, functionalities, and support for specific devices and platforms. Our services may be interrupted for maintenance, repairs, upgrades, or due to network or equipment failures. We may discontinue some or all of our services, including specific features and support for certain devices and platforms, at any time. There are certain events beyond our control, such as natural disasters and other force majeure events, which may affect our services

• You can terminate your relationship with MonBud anytime for any reason by deleting your account. For instructions on how to do so, please go to the settings section on our app or website and click ondelete account
• We may modify, suspend, or terminate your access to or use of our services anytime for any reason, such as if you violate the letter or spirit of our terms or create harm, risk, or possible legal exposure for us, our users, or others. We may also disable or delete your account if it does not become active after account registration or if it remains inactive for an extended period.
• We reserve the right to terminate, change, suspend or discontinue any aspect of the app at any time and without notice.
• The following provisions will survive any termination of your relationship with MonBud: “Disclaimers“ “Limitation Of Liability,“ “Indemnification,“ “Dispute Resolution,“ “Availability And Termination“

Governing Law and Dispute Resolution

In the absence of the establishment of MonBud in your region or jurisdiction and to the future update of this clause of the Terms of Use Agreement:

• You agree to arbitrate any disputes. This Terms of Use is subject to and shall be governed by, and construed by the laws of Nigeria, without reference to the principles of conflict of laws thereof. Any matters arising concerning the interpretation, validity or implementation of this agreement not solved by mutual agreement between the Parties shall be submitted to arbitration in the English language before a sole arbitrator to take place in Lagos, Nigeria as the seat of the arbitration. The arbitration shall be conducted according to the Rules of Arbitration of the Chartered Institute of Arbitrators of the United Kingdom. The arbitral decision shall be final and binding on the Parties and may be made an order of a Court. The Parties unconditionally consent and submit to the jurisdiction of the High Court of Lagos, Nigeria for such purpose.
• Nothing in this Agreement will be deemed as preventing MonBud from seeking injunctive relief (or any other provisional remedy) from any court having jurisdiction over the Parties and the subject matter of the dispute as is necessary to protect MonBud’s name, proprietary information, trade secrets, know-how, or any other intellectual property rights.
• The Parties shall first use their best efforts to amicably settle all disputes arising out of or in connection with the performance or interpretation of these Terms of Use.
• If any provision of this Terms of Use is declared unlawful and/or unenforceable by operation of law, any court or authority, such provision be severed from the rest of this Terms of Use and rendered ineffective so far as is possible without modifying the remaining provisions of this Agreement.
• You agree that regardless of any provision of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Platform or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred and extinguished.

Whole Agreement

This Terms of Use constitutes the whole agreement between the parties (you and FinBud Technologies Ltd.) concerning the subject matter hereof and no warranties or representations of any nature whatsoever other than those set out in this agreement have been given by Monbud (and by extension FinBud Technologies Ltd.).

Declaration

By choosing to proceed, you agree that you understand that you are registering an account with MonBud and that all the information you have supplied is for this purpose. You agree to abide by the above listed Terms of Use which govern our operations. You also agree that the information supplied is true and correct

Finally, you agree to indemnify MonBud for any loss suffered as a result of any false information or error in the information you have supplied us.
